ACCEPTANCE OF TERMS

The following Terms and Conditions Agreement is a legally binding agreement that shall govern the relationship with the users, clients, and visitors which may interact with Stas Bartnikas, also known as the Photographer/Artist, located in Moscow, Russia in association with the use of the website, stasbart.com (the "Site") and its Services, which shall be defined below.  

DESCRIPTION OF WEBSITE SERVICES OFFERED

The Site is an e-commerce/landing website and blog operated by Stas Bartnikas and the affiliated team. These Terms set forth the terms and conditions under which you may use the website and product provided by the Stas Bartnikas.  

This website is the official website of Stas Bartnikas featuring his work, i.e. prints and collaboration items with other parties. All artworks that are listed on the website are available for visitors and/or clients to order online for purchasing. Please read the section about the Purchasing Policy.  

Any and all visitors to the website shall be deemed as "users" of the herein contained Services.

PRIVACY POLICY

Every user's data and other personal information are protected by our privacy policy. As a user, you herein consent to the collection and use of the information provided, including transfer of information for storage, processing, or use by Stas Bartnikas.

 Collection of Information

The website collects various types of information, such as:

• Voluntarily provided information which may include your name, address, email address, billing and/or credit card information, etc., which may be used when you purchase products and/or services and to deliver the services you have requested.

• Voluntarily provided information which may include your name, address, and email address when you sign up for the newsletter. You can opt-out at any time.

• Web analytics which tracks and collects website traffic information for market research to improve and optimize the website and improvement of the users' and/or visitors' experience.

Stas Bartnikas does not now, nor will in the future, sell, rent or lease any of the customer lists, names and/or personal information to any third parties.

Stas Bartnikas may disclose your personal information, without prior notice to you, only if required to do so in accordance with applicable laws and/or in good faith in belief that such action is deemed necessary.

Stas Bartnikas does not knowingly collect personal identifiable information from children under age of thirteen (13) without verifiable parental consent. If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we shall immediately take the necessary steps to ensure that such information is deleted from the system database. Anyone under the age of thirteen (13) must seek and obtain parent or guardian permission to use this website.

Content and images published on this site such as images (both pictures/photos as well as artworks), graphics, text, logos, video and written content is the property of Stas Bartnikas and is protected by Copyright Laws. The entire collection of artworks and content on this website is the exclusive property of Stas Bartnikas and associated parties directly mentioned on the website.

Using Images of Stas Bartnikas Artwork on Social Media, Website, Blog

Stas Bartnikas does allow sharing on social media outlets, but be sure to give the artist credit for his work! Please include the artists' name (stasbart, Stas Bartnikas) and a link to his account or website within the post or stories.

For Bloggers or Website Designers who would like to include an image of the artists' original artwork(s) within a website or blog page please contact us directly for permission. Within the request, please inform the artist with the Title/Name of the artwork of interest and why you would like to include his artwork in the blog or website. 

MODIFICATIONS

Stas Bartnikas shall reserve the right at any time that may deem fit to modify, alter, increase and/or decrease prices, change shipping and handling rates, update services, change of tax rates and/or discontinue, whether temporarily or permanently, our service, or any part thereof, without prior notice. 

THIRD PARTY SERVICES

This website uses third party services and applications that make their services available on this site. When you access third party applications or services or applications, you are bound by the terms and policies of the third party.

COMMENTS, REVIEWS AND EMAILS

Visitors may post content in reply to the articles as long as it is not obscene, threatening, harassing, illegal, infringing on intellectual rights, defamatory, invasive of privacy or injurious in any way towards the Artist or third parties. Content must be free of political campaign, software viruses and commercial solicitation. When you make a public comment/pot within the blog, you grant Stas Bartnikas non-exclusive, royalty-free and irrevocable right to use, modify, reproduce, and publish such content in any of the online media.

INDEMNIFICATION

You agree to indemnify and hold the website owner, Stas Bartnikas, from any demands, loss, claims or expenses (including attorney's fees), made against them by any third party due to or arising from, or in connection with your use of the website or any services offered through the website.

ORDERING POLICY

To create an order, the user must fill up a request form for each artwork or email to sb@stasbart.com. Please include in the request a desired size and design. Once the size, paper, price is agreed by both parties a payment link will be sent to your email.

PRODUCTION OF ARTWORK

All photos are printed on high  museum quality fine art paper from the world's leading manufacturers (Canson, Hahnemuhle, Innova, etc). The final design will be delivered according to your request with the artist's recommendation. 

Available sizes:

- All photos are delivered in two main proportions: 4: 3 and 6: 4, as well as a number of fixed sizes established by the author (cm):

• 60x45 / 60x40

• 90x67.5 / 90x60

• 120x90 / 120x80

• 150x113 / 150x100

• 200x150 / 200x133

Individual sizes are available upon request.

PURCHASING POLICY

The cost of work varies and depends on the photo, size, paper, limitation. You will find out the current price in response to your initial request. For reference: prices start from 2000 EU for a work in the size of 60x40 cm. 

According to the laws of the Russian Federation, from where the shipment takes place, and due to the simplified taxation of the author, photographs are not subject to VAT. The buyer independently pays customs duties and taxes in force in his country of residence.

LIMITED EDITION

All photographs are printed in a limited edition of a maximum of several dozen copies, depending on the work and its size. All photographs are signed personally by Stas Bartnikas with a certificate of conformity also signed by the artist.

The limited edition guarantees the buyer the exclusivity of photographs. The electronic sale and transfer is not allowed unless the buyer wishes to purchase an original photograph for an additional fee. 

REFUND POLICY

All sales are final. All photos are checked before shipping to ensure they meet the print quality parameters and are free from scratches and creases. High-quality prints cannot be returned nor exchanged. In case of damage to the work during transportation (such cases are extremely rare), please contact the artist to handle each case individually.

DELIVERY POLICY

Photos are sent in a shockproof tube by DHL express delivery service to your address. Delivery is free of charge.

STATE GOVERNING LAW

These terms and conditions are governed by the laws of the Russian Federation. You agree and acknowledge that any action to enforce these Terms and Conditions will be brought solely to the Courts located in Moscow, Russia.
